(Syllabus.)
1. Indictment and Information — Sufficiency to Inform Defendant of Offense Intended to Be Charged. The true test of the sufficiency of an indictment or information is not whether it might possibly have been made more certain, but whether it alleges every element of the offense intended to be charged and sufficiently apprises the defendant of what he must be prepared to meet.
2. Arrest — Search Without Warrant as Incident of Legal Arrest. Where a defendant has lawfully been placed under arrest and the arrest is not a subterfuge for the purpose of searching the defendant and his immediate surroundings, he may be searched without the necessity of securing a search warrant.
3. Former Jeopardy — Defendant Accused of Unlawful Possession of Liquor Held not Twice Put in Jeopardy for Same Offense. Facts examined, and found that defendant was not deprived of his constitutional right to be placed in jeopardy only once for the same offense.
