(Syllabus.)
1. Intoxicating Liquors — Known Name of Party Affected Should Be Stated in Affidavit and Search Warrant. Where a search warrant is procured by an officer, and the name of the party whose premises or person to be searched is known, the name should be stated in the affidavit and search warrant.
2. Same — Use of Name "John Doe." It is not always reversible error when the name "John Doe" is substituted. This is especially true when the name of the party is unknown or the name of the party residing on the premises to be searched is unknown.
3. Former Jeopardy — Different Offenses in Same Transaction. The state may not separate or divide an offense into different parts and punish an accused for each of such parts. But where the evidence reveals that two separate and distinct crimes have been committed, one may be prosecuted for each offense. This is a question of fact that may be submitted to the jury or the court.
4. Intoxicating Liquors — Conviction for Unlawful Possession Sustained. Record examined, and judgment and sentence for the unlawful possession of intoxicating liquor sustained.
