(Syllabus.)
1. Former Jeopardy — Jeopardy Statute not Applicable to Different Offenses Though Committed at Same Time and by Same Act. Where the same facts constitute two or more offenses, wherein one offense is not necessarily involved in the other, and where the facts necessary to convict on one of the charges would not necessarily have convicted on the other, the prosecution of one will not be a bar to the prosecution of the other, although the offenses may have been committed at the same time, and by the same act.
2. Same — Criminal Liability for Offenses of Drunken Driving and of Unlawful Transportation of Liquor Committed at Same Time. One charged with the crime of driving a motor vehicle "while under the influence of intoxicating liquor" may also be charged with the crime of unlawful transportation of intoxicating liquor, as a second offender, although the offenses were committed at the same time and by the same act.
3. Judgment and Sentence Modified. Record examined, and judgment and sentence modified from a fine of fifty dollars and one year in the penitentiary to a fine of fifty dollars and six months in the penitentiary.
