(Syllabus.)
1. Arraignment and Pleas — Rearraignment Unnecessary After Dismissal of One of Two Counts in Information. Where an information has two counts, and the county attorney dismisses one of the counts, it is not necessary to again arraign the defendant on the remaining count.
2. Homicide — Duty of Court in Murder Prosecution to Instruct Jury on First and Second Degree Manslaughter. Where defendant is charged in the information with the crime of murder, if the facts warrant, it is not only proper for the court to instruct the jury in reference to manslaughter in the first and second degree, but it is his duty to do so.
3. Homicide — Unnecessary to Allege and Prove Homicide Was Perpetrated Without Design to Effect Death Where Charge Is Murder by Person Engaged in Commission of Felony. It is not necessary to allege and prove that the homicide was perpetrated without a design to effect death, where one is charged with murder while engaged in the commission of a felony.
4. Indictment and Information — Information for Murder Held not Duplicitous. Information examined, and found not to be duplicitous.
5. Evidence — Evidence of Flight Immediately After Commission of Crime Admissible as Part of Res Gestae. Evidence of flight immediately after the commission of a crime is admissible as a part of the res gestae, and is not proof of an independent and separate crime.
6. Evidence — Admissibility of Transcript of Testimony Taken at Preliminary Examination Where Witness Had Removed From State. It is the well-established doctrine in this state that where the testimony of the witness was given at a preliminary examination, and taken down by the reporter in the presence of the defendant and his counsel, who cross-examined him, and such testimony was filed with the clerk, the transcript is admissible, where the witness is not present and has permanently moved from the state and therefore cannot be found in the jurisdiction of the court.
7. Automobiles — Evidence Held to Sustain Conviction of Second-Degree Manslaughter Perpetrated by One Driving Automobile While Intoxicated. Evidence examined, and found not to be the result of passion or prejudice.
