The petitioners are seeking regular bail in FIR No. 171 dated 07.03.2015, registered under Sections 147, 148, 149, 323, 354(B) IPC (Section 307 IPC added later on); Section 3 of SC/ST Act and Section 25 of the Arms Act, Police Station Hodal, District Palwal.
Heard.
Counsel for the petitioners contends that FIR no.170 had been recorded prior to the present FIR in which all the prosecution witnesses had turned hostile as there was a compromise. He further states that Kanta who had got the FIR

lodged also did not support the prosecution version though Rajinder chose to support the prosecution story. It was urged that the MLR of Rajinder is available on record, which shows the injury and the patient had visited private hospital and the dimensions of the injury are not noted there. Counsel for the petitioners urges that the petitioners are in custody since 18.05.2015 and trial will take time.
Without going into the question as to whether there is a compromise or the complainant turned hostile, the petition is allowed and the petitioners are directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of trial Court/Duty Magistrate.
