(Syllabus.)
1. Rape — Conviction May Be Had on Uncorroborated Testimony of Prosecutrix. It has been definitely settled by the decisions of this court that one may be convicted in a rape case upon the uncorroborated testimony of the prosecutrix.
2. Same — When Testimony of Prosecutrix Must Be Corroborated. But in cases of this character, the evidence of the prosecutrix must not be contradictory, uncertain or improbable, and she must not have been impeached. Under these circumstances it is necessary that her testimony be corroborated.
3. Appeal and Error — Sufficiency of Evidence to Support Conviction. The general rule, as often stated by this court, is that where there is any evidence to support the verdict, or where the evidence is conflicting, appellate court will not examine record to determine weight of evidence and verdict approved by trial judge will be allowed to stand.
4. Same — Rape — Review of Evidence Where Testimony of Prosecutrix Unsatisfactory. But in rape cases, where the evidence of prosecutrix is contradictory, uncertain, improbable or she has been impeached, and it is necessary under the law that her evidence be corroborated, there is a well-founded exception to the general rule above stated.
5. Same — Testimony of Prosecutrix Held Clear and Convincing and Properly Corroborated. Record examined, and evidence found that testimony of prosecutrix was clear and convincing. That it was not contradictory, and that she was not impeached, and her testimony was properly corroborated.
6. Trial — Requested Instruction in Rape Case Properly Refused Where General Instructions Sufficient. A requested instruction that in cases of this character the testimony of the prosecutrix should be viewed with great caution was properly refused in view of the facts and circumstances in this case, and the general instructions given by the court.
