(Syllabus.)
1. Searches and Seizures — Requirement for Search Warrant Held not Waived by Statement of Owner of Premises. The statutes provide that before the place of business or residence of a citizen of this state shall be searched, it is the duty of the officer searching the same to procure a search warrant in the manner provided by law. The consent to waive the issuance of the search warrant shall be voluntary and not in reply to the officer's statement that they are there "to look his place over."
2. Trial — Requisites of Instructions — Improper for Court to Mention Any Particular Instruction as Having Been Requested by State or Defendant. The instructions should embrace the law applicable to the particular facts in the case. It is the best practice for the court in instructing the jury to not mention the fact that any particular instruction was given at the request of either the state or the defendant.
