(Syllabus.)
1. Searches and Seizures — Duties of Officers Respecting Search Warrants. When an officer intends to search the premises of a citizen of this state, it is his duty to procure a search warrant for this purpose. When the search warrant is executed it becomes his duty under the law to make a return to the court issuing the same, stating what was found in the execution of the warrant. 2. Appeal and Error — Reversal for Insufficiency of Evidence to Support Conviction. It is the rule of this court that it will not set aside the verdict of a jury where there is any evidence to uphold it, but it is also the duty of the court where the verdict is based only upon a few suspicious circumstances, and no substantial evidence, to set the same aside.
