(Syllabus.)
1. Appeal and Error — Trial — Duty of Counsel to Submit Instruction Covering Theory of Defense — Sufficiency of Instructions Absent Request. Upon ascertaining that the court has failed to give an instruction covering the theory of his defense, it is the duty of counsel to prepare and present to the court a correct and complete instruction, and request that it be given. And in the absence of such request this court, where it finds that no fundamental error has been made in the instructions, and that as a whole they fairly embody the law applicable to the case, the same will not be reversed.
2. Trial — Proper Procedure for Court's Communication With Jury After Retirement to Deliberate on Verdict. After the jury retires to deliberate on its verdict, the court should only communicate with them with reference to any material matter, in open court, and where practicable, only in the presence of counsel for defendant, to the end that the rights of defendant may be properly protected.
3. Homicide — First-Degree Manslaughter — Sentence Reduced From 15 to 7 Years. Record examined, and judgment reduced from 15 years to seven years in the penitentiary.
