(Syllabus.)
1. Trial — Duty of Trial Judge to Remain in County During Deliberations of Jury. When the trial of a criminal case is closed, and the jury has retired to deliberate upon its verdict, it is the duty of the trial judge to remain in the county where the case is on trial until a verdict is returned or the jury discharged.
2. Same — Proper Procedure for Judge's Communication With Jury After Retirement to Deliberate on Verdict. After the jury has retired to deliberate on its verdict, any communication or instructions given them by the judge should be in open court in the presence of, or after notice to, the county attorney and the defendant or his counsel, or after they have been called.
3. Same — Manslaughter Conviction Reversed Where Trial Judge Phoned From Another County to Jury Foreman Concerning Jury's Inability to Agree on Punishment. It was error for the trial judge who was in a county other than the one where defendant was on trial, to have a conversation over the phone with the foreman after the jury had retired to deliberate on its verdict with reference to the case on trial. For facts justifying a reversal of this case, see opinion.
