(Syllabus.)
1. Punishment — Industrial School for Girls not "Penal Institution" to Which One Convicted May Be Sentenced by District Court. The Industrial School for White Girls at Tecumseh is not a penal institution, and the district court does not have the right or authority to sentence any one to that institution, after trial and conviction in the district court.
2. Infants — Preliminary Proceeding in Juvenile Court Required to Give District Court Jurisdiction to Try Children Under Certain Ages. Under article 1, chapter 14, Session Laws 1935, O.S.A. title 10, § 101, before a district court can obtain jurisdiction to try a child under the age of 16 years, it is necessary for a preliminary hearing to be held by the juvenile court, and for this court to certify to the district court its findings, that the child was in fact capable of committing the crime charged, and there was probable cause to believe him or her guilty.
3. Indictment and Information — Sufficiency in General — Liberal Construction. This court, for the purpose of avoiding technical construction of criminal pleadings, has adopted a liberal rule, that where the indictment or information charges the crime in ordinary and concise language, and in such manner that a person of common understanding is enabled to know what is intended, and which defines and identifies the offense so that the accused will be enabled to defend himself if charged again with the same offense, it will not be set aside.
4. Same — Prejudicial Error in Permitting Material Amendment of Information After Both Sides Closed Their Case. But where the court permits the information to be amended, over the objection of defendant, after both the state and defendant have closed their case, and such amendment is material and the defendant is prejudiced thereby, the same is error.
5. Larceny — Robbery — Crimes Distinguished. The distinction between robbery and larceny from the person is very close. The distinguishing element is that to constitute robbery either "force" or "fear" must be exerted. In larceny these elements are unnecessary.
6. Robbery — Larceny From Person not Included Offense of Conjoint Robbery. Larceny from the person is not an included offense where one is charged with the crime of conjoint robbery.
7. Same — Evidence Held not to Sustain Conviction of Two Small Girls of Conjoint Robbery. Evidence reviewed, and case reversed with suggestion that if defendants are again tried, that they be charged with larceny from the person, and not with the crime of conjoint robbery.
