(Syllabus.)
1. Infants — Statute Conferring on County Court Duties of "Juvenile Court." Section 1729, Okla. Stats. 1931, 10 Okla. St. Ann. § 101, defines "dependent" and "delinquent" children, and the sections following confer upon the county courts of this state the duties of a "juvenile court."
2. Same — Minors Under Certain Ages Charged With Felony — Jurisdiction of District Court Dependent on Preliminary Hearing in Juvenile Court. Before a district court can obtain jurisdiction to try a male child under 16 years of age, or a female under the age of 18 years, who are charged with a felony, it is necessary for a preliminary hearing to be held by the juvenile court, and for this court to certify to the district court its findings that the child was in fact capable of committing the crime charged, and there was probable cause to believe him or her guilty.
3. Same — Duty of Court to Certify Question of Age to Juvenile Court. When the question of the age of the defendant is properly raised it is the duty of the court to certify this question to the juvenile court for proper investigation and determination before assuming jurisdiction to try the case.
4. Same — Statutes Creating Juvenile Court Liberally Construed in Harmony With Purpose. The creation of the "juvenile court" is in harmony with the trend of modern times in the treatment of juvenile offenders to the end that reformation, if possible, may be brought about without the necessity of association with hardened criminals, and the courts in construing these statutes have universally held they are entitled to a liberal construction.
