(Syllabus.)
1. Arraignment and Pleas — Discretion of Court as to Setting Aside Plea of Guilty. Where a plea of guilty has been entered, and a motion is made to set the same aside and permit the entering of plea of not guilty, the sustaining or granting of the motion is within the discretion of the trial court and will not be set aside unless in the opinion of the court there has been an abuse of discretion.
2. Same — Statute Liberally Construed. Under the facts stated above, the court will place a liberal construction upon Oklahoma Statutes 1931, section 2961, O.S.A. (Stat. 1941), Title 22, § 517, in permitting the withdrawal of the plea of guilty, to the end that defendant may be tried by a jury of his peers, but the court will not grant the motion if justice does not so demand.
3. Same — Arraignment Waived by Pleading Guilty or Standing Trial for Misdemeanor. Where one enters a plea of guilty or stands trial without objection for a misdemeanor he waives the right of arraignment. 4. Appeal and Error — Scope of Review of Decision on Motion to Set Aside Plea of Guilty. Where a preliminary motion is filed and evidence is heard by the court before the trial, the court will consider all of the evidence, together with record, and minutes of the court which were introduced in evidence at the hearing.
