(Syllabus.)
1. Evidence — Evidence of Acts of Both Defendants Where Severance Taken. Where one is charged jointly with another of an assault with intent to kill, and a severance is taken, it may become necessary for the trial court in his discretion to permit evidence of the acts and conduct of both defendants to be heard by the jury.
2. Evidence — Introduction of Evidence Subject to Restrictions by Trial Court. The introduction of evidence in a criminal case is subject to such restrictions or limitations as the trial court in its discretion may decide.
3. Appeal and Error — Verdict of Conviction not Set Aside Because of Conflict in Evidence. When there is a conflict in the evidence, the verdict of the jury will not be set aside. It is only when the evidence is insufficient to sustain the judgment and sentence that an appellate court will interfere.
4. Punishment — Three Years in Penitentiary for Assault With Intent to Kill Held not Excessive. Record examined, and found that the punishment inflicted, where defendant was found guilty of an assault with intent to kill and given three years in the penitentiary, did not constitute cruel and unusual punishment, and under the facts was not excessive.
