DISMISSAL ORDER
On July 8, 2026, after self-represented prisoner Jamilee Isaiah Kignak (Plaintiff) filed a statement that the Court construes this statement as potentially indicating Plaintiff's intent to voluntarily dismiss this case, the Court issued a Notice of Intent Dismiss providing 30 days from the date of the order to notify the Court in writing that he intends to proceed with this case.2The Court warned Plaintiff that failure to notify the Court if he intends to proceed with this case would result in

dismissal of this case as a "strike" without further notice to Plaintiff.3To date, Plaintiff has not responded or otherwise contacted the Court.
DISCUSSION
Rule 41(b) of Federal Rules of Civil Procedure permits dismissal due to a plaintiff's failure to prosecute or comply with a court order. In deciding whether to dismiss on this basis, a district court considers five factors: "(1) the public's interest in expeditious resolution of litigation; (2) the court's need to manage its docket; (3) the risk of prejudice to the defendants; (4) the public policy favoring disposition of cases on their merits; and (5) the availability of less drastic sanctions."4 Here, Plaintiff filed a statement that the Court construes as a Notice of Voluntary Dismissal. Plaintiff has not responded to the Notice of Intent to Dismiss this case, and he has not offered any justifiable reason for failing to meet the Court's deadline. Based on the foregoing, this case must be dismissed for failure to prosecute. The Court finds no other lesser sanction to be satisfactory or effective in this case.5Because Plaintiff was a prisoner at the time this case was filed, this dismissal will count as a "strike" under § 1915(g).6

IT IS THEREFORE ORDERED:
1. This action is DISMISSED.
2. This dismissal counts as a "strike" under 28 U.S.C. § 1915(g), which may limit Plaintiff's ability to bring future civil rights cases in federal court.
3. All pending motions are DENIED as moot.
4. The Clerk of Court shall issue a final judgment and close this case.
