In Re Daniel Flores v. the State of Texas

NUMBER 13-25-00463-CV

COURT OF APPEALS

THIRTEENTH DISTRICT OF TEXAS

CORPUS CHRISTI - EDINBURG

IN RE DANIEL FLORES

ON PETITION FOR WRIT OF HABEAS CORPUS

ORDER OF ABATEMENT

Before Chief Justice Tijerina and Justices Cron and Fonseca Order Per Curiam

This cause is currently before the Court on its own motion. By pro se petition for writ of habeas corpus, relator Daniel Flores asserts that he has been wrongfully confined for civil contempt since January 13, 2025. Relator asserts that he properly filed an objection to the assigned judge prior to the hearing on a motion for contempt against him, yet that assigned judge nevertheless proceeded to hold him in contempt for failing to appear at the hearing. Relator further contends that he has been denied a release hearing under Texas Family Code § 157.105. See TEX. FAM. CODE ANN. § 157.105.

The Court requested responses to the petition for writ of habeas corpus from the real party in interest, Stacy Garza a/k/a Stacy M. Garza, and relator's appointed counsel, the Honorable Carolyn M. Gurney; however, the Court did not receive any responses to the petition for writ of mandamus. The respondent advises us that a hearing has been set on Garza's motion for contempt against relator on October 9, 2025. Given the foregoing, we abate this original proceeding. We direct the trial court to proceed with the scheduled hearing and any related matters regarding § 157.105, and to provide this Court with a transcript of this hearing. The transcript will be due on October 15, 2025. We further direct relator's appointed counsel to advise this Court regarding the effect of this hearing on this petition for writ of habeas corpus within that same period of time.
