ORDER1
The Respondent’s motion to dismiss paragraph 10 of the consolidated complaint on the
basis that it is time-barred under Section 10(b) of the Act is denied. The Respondent has failed
to demonstrate that there are no genuine issues of material fact warranting a hearing and that it is
entitled to judgment as a matter of law on the timeliness issue. This denial is without prejudice
to the Respondent’s right to raise its defense under Section 10(b) of the Act before the
administrative law judge and before the Board on any exceptions that may be filed to the judge’s
decision, if appropriate.
