UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD
DIVISION OF JUDGES
ORDER
Respondents’ Motion to Dismiss or, in the Alternative to Stay, is denied.1 The
Respondents contend that the matters alleged in the complaint should be deferred to the
grievance-arbitration procedure in accordance with the Board ’s decision in Dubo Mfg. Co., 142
NLRB 431 (1963). The Board, however, has long adhered to a policy of refusing to defer
information-request allegations. 2 The Respondents have presented no valid reason to depart
from that policy here.
Dated, Washington, D.C., September 3, 2025.
Robert A. Giannasi
Chief, Administrative Law Judge
