STATEMENT OF THE CASE
The Defendant, Daryl G. McGhee, was charged by indictment with three federal crimes: Count I - Possession of a Cocaine with Intent to Distribute, Count II - Felon in Possession of a Firearm, and Count III - Possession of a Firearm in Furtherance of a Drug Trafficking Crime.
The possession of a firearm crime charged in Count II has been disposed of and is no longer of concern to you. This trial concerns only Counts I and III: The drug trafficking crime charged in Count I - Possession of a Cocaine with Intent to Distribute, and Count III - Possession of a Firearm in Furtherance of the Drug Trafficking Crime charged in Count I. The Defendant has pled not guilty to both charges. The Government and the Defendant are entitled to have you decide the charges in these Counts entirely on the evidence that will come before you in this trial.
