ARMSTRONG v. ARMSTRONG.

BIRD, V. C.

Mr. Armstrong, for complainant.

Mr. Carroll, for defendant.

BIRD, V. C. I think the complainant has made her case. I think the defendant carefully prepared to abandon his wife. The wife still expresses a willingness to live with him, if he will provide a home for her; but he says he did not abandon her, nor did he intend to do so. Evidently, therefore, they ought not to be separate. However, I find that he did abandon her. This being so, I will advise an order that he pay her three dollars per week as alimony, and the costs of this proceeding, unless he provide a home for her and live with her within 15 days from the time of a service of the decree in this cause. In case he does so, he will then still be chargeable with the costs to be taxed in this case.
