LESTER A. FETTIG Plaintiff v. TOUCHSTONE DEVELOPMENT CORPORATION, et.al. Defendants

Thomas D. Horne, Judge

MEMORANDUM OPINION AND ORDER

Following the entry of the Court's order of January 8, 2001, in which Christine Mougin-Boal, Esquire was appointed as custodian of the corporate Defendant pursuant to Complainant's request for Pendente Lite relief, the Court has reviewed various issues raised by the pleadings touching upon the administration of the corporation. The Court appointed custodian promptly filed a preliminary report with the Court.

Subsequent hearings were heard in this matter on February 2, 2001, March 2, 2001, and March 7, 2001. At the hearing on February 2, 2001, the Court consolidated for hearing Chancery No. 20452 and Chancery No. 20492; took under advisement Plaintiff's motion to disqualify counsel and instructed the Plaintiff to file supplemental responses to the cross petition in Chancery No. 20452. On March 2, 2001, the Court granted the motion of Complainant for emergency relief and granted the motion for Pendente Lite relief by way of both injunctive relief and the appointment of a receiver pursuant to Va. Code Ann. § 13.1-747(E). It appearing to the Court that the shareholder of the corporation acquiesced in such relief, the Court doth appoint Christine Mougin-Boal, Esquire, as Receiver Pendente Lite, said appointment being by Order entered this date.

ENTERED this ___ day of March, 2001.
