ELLEN SEGAL HUVELLE
Defendant's motion for summary judgment granted in part and denied in part.
James E. Murphy, Cumberland, MD, pro se. Wenqiong Fu, United States Attorney's Office, Washington, DC, for Defendant.
MEMORANDUM OPINION AND ORDER
ELLEN SEGAL HUVELLE, United States District Judge
In this pro se action brought under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, plaintiff challenges the response of the Executive Office for United States Attorneys (“EOUSA”) to two FOIA requests he made for information pertaining to two grand juries. Defendant has moved to dismiss under Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim upon which relief can be granted or for summary judgment under Rule 56. (Def.'s Mot. to Dismiss or, in the Alternative, for Summ. J. [ECF No. 10].) Plaintiff has filed an opposition to the motion [ECF No. 13] and defendant has filed a reply [ECF No. 19]. Upon consideration of the parties' submissions and the entire record, the Court will grant in part and deny in part defendant's motion for summary judgment and direct defendant to release certain withheld information, if it exists in an agency record.
