The defendant's petition for certification for appeal from the Appellate Court is treated by the court as an application filed pursuant to General Statutes § 52–265a.
The Chief Justice granted the § 52–265a application, limited to the following issues:
“1. Did the Appellate Court properly determine that the trial court correctly set bail for the defendant, rather than releasing him, when probable cause for the arrest of the defendant was found by the court more than forty-eight hours after his arrest?
“2. If the trial court was required to release the defendant pursuant to Practice Book § 37–12, is there any limitation on what conditions of release could be imposed by the trial court?”
