(Syllabus.)
1. Trial — Right to Reasonable Time to Prepare for Trial. It is a well-settled rule of law in this state that one charged with crime is entitled to a reasonable time in which to prepare for trial, and what constitutes a reasonable time will depend upon the facts and circumstances surrounding each particular case.
2. Same — Constitutional Rights Guaranteed to Every Person in Criminal Action. The constitutional provisions guaranteeing to every person in a criminal action certain rights are: First, those in which the public generally and as a community, as well as the accused, is interested, and which are jurisdictional as affecting the power of the court to try the cause; second, those more in the nature of privileges which are for the benefit of the accused alone, and do not affect the general public.
3. Jury — Right to Trial by Jury May Be Waived.
4. Appeal and Error — Trial — No Abuse of Discretion of Trial Court in Refusing to Grant Continuance in Felony Case. An application for continuance in a felony case is addressed to the sound discretion of the trial court, and unless an abuse of such discretion clearly appears, the Criminal Court of Appeals will not reverse the judgment for a refusal to grant a continuance.
