The appellant moved in arrest of judgment and filed the following grounds:
And thereupon the said Peter Wilson says that judgment ought not to be given upon the verdict aforesaid, but that judgment ought to be arrested; and as causes for arresting the said judgment the said P. Wilson assigns the following: —
1. The case aforesaid is brought before this Court by appeal from a justice of the peace, and it appears that a justice of the peace had no jurisdiction over the cause of action, the wrong complained of not being within the cognizance of a justice of the peace.
2. The appeal aforesaid was brought and the proceedings therein had by virtue of and according to the form of an Act of the General Assembly entitled "An Act for the more easy and speedy recovery of small debts"; and that this Act of Assembly was repealed before the issue in the case aforesaid was tried, and therefore there was no law under which said trial could be had.
