(Syllabus.)
1. Continuance — Member of Legislature During Session Entitled to Continuance of Cases in Which He Is Attorney of Record. Under section 396, Okla. Stats. 1931 (Okla. St. Ann. tit. 12, sec. 667), a member of the Legislature is entitled to a continuance of cases in which he is attorney of record as a matter of right during the time he is serving as a member of the Legislature in actual session.
2. Same — Discretion of Court as to Continuance Where Attorney Employed During Session of Legislature. If such employment is had while the Legislature is in session, such application is addressed to the sound discretion of the trial judge. It is error to abuse this discretion. 3. Same — Refusal of Continuance on Ground of Sickness of Defendant's Attorney Held Abuse of Discretion. Record examined, and found that the overruling of the motion for continuance because of the absence of defendant's attorneys on account of sickness was an abuse of discretion.
