(Syllabus.)
1. Assault and Battery — Assault and Battery by Means of Deadly Weapon or Other Means Likely to Produce Death — Essential Elements of Crime to Be Proved.
2. Same — Pocket Knife not Necessarily "Deadly Weapon." A pocket knife is not necessarily a deadly weapon.
3. Evidence — Assault and Battery by Means of Deadly Weapon — Bloody Clothing Held Inadmissible Where Location of Wounds not in Doubt. It is permissible to introduce the bloody clothing when their introduction serves to illustrate some point or solve some question or throw light upon some matter connected with the proper solution of the case. Under the facts in this case the clothing should not have been admitted in evidence, as there was no doubt as to the location of the wounds, and no issue they would tend to throw light upon.
