(Syllabus.)
1. Trial — Purpose of Constitutional Requirement That List of Witnesses Be Served. The purpose of the requirement of article 2, section 20, of the Constitution, Okla. St. Ann., that a list of witnesses be served, is to apprise defendant who the witnesses are, where they may be found, and to enable him to investigate their testimony, their character, and credibility; it was never intended that the provision should operate as a means to defeat justice by a too strict or technical construction.
2. Robbery — General Statute Defining Robbery not Superseded or Repealed by Statute Dealing With Robbery With Dangerous Weapon. Oklahoma Statutes 1931, section 2543, 21 Okla. St. Ann. § 801, does not supersede or repeal Oklahoma Statutes 1931, section 2542, 21 Okla. St. Ann. § 791, defining robbery. It is a statute of classification, and not definition.
