(Syllabus.)
1. Arrest — Warrant not Necessary for Arrest and Search Where Officer Observes Bottles of Whisky Within Moving Automobile. Where one is transporting large quantities of liquor upon or approaching the public highway, and an officer in the lawful discharge of his duty observes through the window of the car the intoxicating liquor upon the seat and floor of said car, it is not necessary to procure a search warrant before arresting defendant and searching the automobile, for the reason that a crime is being committed in his presence.
2. Intoxicating Liquors — Unlawful Transportation — Distance of Transportation Immaterial. Where one is charged with the illegal transportation of intoxicating liquor from one place to another in this state, and where it is apparent that the conveyance was made to facilitate the barter or sale of liquor, the distance over which it was carried or moved is immaterial.
3. Appeal and Error — Harmless Error in Instructions. By reason of the terms of Oklahoma Statutes 1931, section 3206, 22 Okla. St. Ann. § 1068, a case will not be reversed by reason of an error in an instruction unless the error was such that had "probably resulted in a miscarriage of justice, or constitutes a substantial violation of a constitutional or statutory right."
4. Same — In View of Objectionable Instruction, Sentence for Unlawful Transportation of Liquor Reduced. Record examined, and judgment and sentence modified from a fine of $250 and 90 days in jail to a fine of $250 and 45 days in jail.
