(Syllabus.)
1. Judgment and Sentence — Process Should Be Served by Officer Within Reasonable Time. In the absence of statute, criminal process coming into the hands of a public officer should be served within a reasonable time.
2. Same — "Reasonable Time" Dependent on Facts of Case. As to what constitutes a reasonable time depends upon the facts of the individual case.
3. Habeas Corpus — Delay of 11 Years in Service of Commitment Unreasonable and Defendant Was Entitled to Discharge. Where the record reveals that the mandate of this court was returned to the county court, and process was placed in the hands of the sheriff and never served for a period of eleven years and four months, this will be considered under the facts in this case an unreasonable time, and defendant will be released by habeas corpus. Public policy and justice demands this action.
