(Syllabus.)
1. Appeal and Error — Admission of Immaterial Evidence Harmless Where Defendant Testifies to Same Facts. Although immaterial evidence may be introduced by the state, yet if a defendant, on cross-examination of witnesses, and by taking the witness stand, testifies to the same facts, the receiving of the immaterial testimony may become harmless, and not be grounds for reversal.
2. Trial — Refusal to Give Requested Instructions not Error if Unnecessary to Proper Decision of Issues. Although requested instructions may contain correct abstract principles of law, yet if they are not necessary to a proper decision of the issues involved, it is not error for the court to refuse to give them.
3. Same — Requested Instructions Covered in General Charge. Where the instructions as a whole present the issues involved, it is not error to refuse requested instructions which cover the same issue, although expressed in different form.
4. Breach of the Peace — Definition of Offense.
5. Same — No Defense That Other Party Was Guilty of Same Offense. It is no defense to a charge of a breach of the peace that the other party was at the same time guilty of the same offense. The public is the one concerned with a breach of the peace, and not the individual.
6. Same — Punishment Reduced by Eliminating Jail Sentence. Record examined, and judgment and sentence of a fine of $25 and 30 days in jail, assessed against two defendants, modified to a fine of $25 against each defendant and costs.
