(Syllabus.)
1. Preliminary Examination — Holding Accused to Answer. When a complaint is filed in the justice court, or the county court sitting as an examining magistrate, the person charged is entitled to a preliminary hearing, and if after said hearing it is determined that a public offense has been committed, and there is sufficient cause to believe the party charged committed the same, it is the duty of the court to order "that he be held to answer the same."
2. Same — Bail — Admitting Accused to Bail. If the offense is bailable, there should be endorsed on the bail bond these words, "and I have admitted him to bail to answer, by the undertaking hereto annexed."
3. Same — Examining Magistrate not Authorized to Set Date for Trial. There is no provision in the statute for the examining magistrate to set the exact date of defendant's trial in the district court. This is within the province of the trial court in the manner prescribed by law.
4. Same — Trial — Power of District Court to Set Trial at Date Earlier Than That Set in Appearance Bond. It is within the power of the trial court to set the trial of a defendant at a date earlier than that set for his appearance in a bond taken by the examining magistrate, subject to defendant's right to file a motion for continuance in the manner provided by law.
5. Appeal and Error — Continuance — Discretion of Trial Court as to Granting Continuance. A motion for continuance is largely within the discretion of the trial court, and unless this discretion is abused, or the defendant is entitled to a continuance as a matter of law, the refusal of the same by the court will not be set aside on appeal.
6. Appeal and Error — Sufficiency of Conflicting Evidence to Sustain Conviction. Where the evidence is conflicting, and that offered by the state is sufficient to sustain the conviction, the judgment and sentence entered will not be set aside on appeal.
7. Larceny — Evidence Sustained Conviction for Larceny of Livestock. Record examined, and found sufficient to sustain the charge of larceny of livestock.
