(Syllabus.)
1. Indictment and Information — Test of Sufficiency. The true test of the sufficiency of an indictment or information is not whether it might possibly have been made more certain, but whether it alleges every element of the offense intended to be charged and sufficiently apprises the defendant of what he must be prepared to meet.
2. Same — Defects Waived by Going to Trial Without Objections. Where no demurrer or motion to quash the information is filed, and a plea of not guilty is entered, and trial is had, defendant waives any defect in the indictment or information, except that the court had no jurisdiction of the subject matter and that no public offense had been committed, which matters may be raised at the trial and by motion in arrest of judgment.
3. Same — Material "Variance". A variance in a criminal case is an essential difference between the accusation and the proof; and a variance is not material unless it is such as might mislead the defense, or expose the defendant to the injury of being twice put in jeopardy for the same offense.
4. Assault and Battery — Assault With "Dangerous Weapon". The manner of use of an instrument may be controlling factor in determining whether it is a "dangerous weapon," within statute providing punishment for assault with a dangerous weapon.
5. Same — Shoes not "Dangerous Weapons" per Se.
6. Same — Shoes not so Used as to Constitute Dangerous Weapons. Evidence examined, and found that the manner of use by defendant of his shoes was not such as to constitute them a dangerous weapon.
7. Same — Submission to Jury of Included Offense of Assault and Battery. Where one is properly charged with assault with a dangerous weapon as provided in 21 O.S.A. 1941 § 645[ 21-645], the crime of assault and battery as provided by 21 O.S.A. 1941 §§ 641[ 21-641], 642, is an included offense, and the district court, having properly assumed jurisdiction, had the right to submit to the jury the included offense, though this crime is a misdemeanor.
8. Same — Reduction of Penitentiary Sentence.
