(Syllabus.)
1. Evidence — Opinion Evidence — Hearsay.
2. Same — False Pretenses — Parts of Letter Expressing Opinion as to Guilt of Defendant Inadmissible. Where one is charged with the crime of obtaining money by false pretenses, it was error to admit in evidence parts of a letter written by a third party to one other than the defendant in which the defendant was referred to as a "racketeer," and as one who in the opinion of the writer of the letter was guilty of committing a fraud by the taking of $8,000.
3. Witnesses — Cross-Examination. Such testimony does not become competent, though offered as cross-examination of witness offered by the defendant, where the direct examination of the witness did not refer to or contradict the letter in any way.
