(Syllabus.)
1. Appeal and Error — Sufficiency of Evidence to Sustain Conviction for Assault With Dangerous Weapon. Where there is substantial evidence to support the verdict, conviction will not be reversed on ground of insufficiency of evidence merely because evidence is conflicting. 2. Evidence — Testimony of Absent Witness Given at Preliminary Hearing. Where a witness has testified at a preliminary hearing, and the testimony taken down in shorthand and transcribed and filed in the office of the court clerk, and the defendant had an opportunity to cross-examine him, the evidence so given may be read as the evidence of the witness, where it is shown that the witness is sick and unable to attend trial.
3. Same — Presumption That Defendant Present When Evidence of Witness Taken at Preliminary Hearing in Absence of Proof to Contrary. Where the evidence of a witness is taken at a hospital at the time of the preliminary hearing, and the record reveals that the magistrate and the attorneys for the state and the defendant were present, but is silent as to the actual presence of the defendant, in the absence of proof to the contrary, the presumption is that he was present.
4. Same — Purpose of Statutes Complied With When Witness Cross-Examined. The main and essential purpose of the provision of the Constitution and the statute that a defendant must be "confronted with the witnesses against him," is for the purpose of securing an opportunity of cross-examination. When this is done, the Constitution and statute have been complied with.
