(Syllabus.)
1. Habeas Corpus — Writ May not Be Substituted for Appeal. Habeas corpus may not be substituted for appeal.
2. Appeal and Error — Relief Granted Only When Judgment Void or Court Without Jurisdiction. As a proposition of law, the Criminal Court of Appeals will not review the evidence of the trial on habeas corpus proceeding, but will only grant relief when the judgment is void, or the court did not have jurisdiction to render the judgment and sentence.
3. Judgment and Sentence — Evidence Insufficient to Justify Setting Sentence of Execution Aside. Petitioner was sentenced to be executed. He sought his release by reason of newly discovered evidence. This evidence was examined by the Criminal Court of Appeals by reason of sentence imposed, and found that it did not justify setting aside the judgment and sentence entered against petitioner.
