(Syllabus.)
1. Larceny — Appeal and Error — Sufficiency of Conflicting Evidence. Where one is charged with the crime of larceny of live stock and the evidence is conflicting, the judgment and sentence will not be set aside where the evidence is sufficient to sustain the same.
2. New Trial — Discretion of Trial Court as to Granting New Trial for Newly Discovered Evidence. The granting of a motion for new trial on the ground of newly discovered evidence is addressed to the sound discretion of the trial court, and such motion should not be sustained unless there is a reasonable probability that the newly discovered evidence would have changed the result of the trial.
3. Same — Practice of Granting New Trials on Affidavits of Convicted Persons Admitting They Had Committed Perjury not Favored by Courts. The practice of granting new trials upon affidavits of persons who have been convicted and then changed their testimony admitting that they had committed perjury, is not looked upon with favor by the courts.
