Attorney General. Labor, Wages. Contract, Employment. Words "Special contract."
An employer's written policy, under which an employee found by the employer to be at fault in an accident involving the employer's vehicles could agree to a deduction from his or her earned wages in lieu of discipline, constituted a "special contract" in contravention of G.L. c. 149, § 148, a provision of the Massachusetts Wage Act (Wage Act) [759-761]; further, the wage deductions made by the employer under the policy did not amount to valid set-off deductions within the meaning of § 150 of the Wage Act, where, given that the employer served as the sole arbiter making a unilateral assessment of liability and damages, no clear and established debt existed [761-764].
