1. There being no express power of sale given to the executors by the will and no words from which such a power might clearly be inferred, this court will not require the vendee to accept title from the executors where they seek specific performance of a contract for the sale of certain real estate which the testator expressed a wish "be sold * * * by free-hand sale at as high a market price cash as can be secured for charitable purposes."
2. A gift for charitable purposes, in order to be valid, must be sufficiently definite to permit the testator's intention to be carried out.
PER CURIAM.
The decree appealed from will be affirmed, for the reasons stated in the opinion of Vice-Chancellor Bigelow.
For affirmance — THE CHIEF-JUSTICE, TRENCHARD, PARKER, CAMPBELL, LLOYD, CASE, BODINE, DALY, DONGES, VAN BUSKIRK, KAYS, HETFIELD, DEAR, WELLS, JJ. 14.
For reversal — None.
