Equity — Jurisdiction — Tort — School district — Negligence of its agents.
1. Equity does not have jurisdiction over an action to recover damages for a tort for which there is an adequate remedy at law. [460]
2. A school district is a state agency, performing governmental functions, and is not liable for the negligence or misfeasance of its officers or agents. [459]
3. In a proceeding in equity, in which plaintiff, a sculptor, averred that he had prepared certain models to be placed upon a building of the school board, for which he was paid in full, that his models were so changed, by direction of the school board, that he had been subjected to the ridicule and contempt of artists and had found it difficult to obtain other contracts for sculptural work, and in which plaintiff sought compensation for the damage to his reputation, that the defendant school district be directed to tear down the sculptural units and be enjoined from declaring that the work was performed by plaintiff, and that plaintiff be permitted to replace all the sculptural units to his own satisfaction, it was properly held that plaintiff had not set forth any right justifying the issuance of an injunction and the relief prayed for. [458-60]
