(Syllabus.)
1. Jury — Right to Challenge Panel on Account of Bias of Officer Summoning Talesmen. Under the provisions of section 2987, Oklahoma Statutes 1931, Okla. St. Ann. tit. 22, § 639, when a panel is formed, or in part formed, from jurors whose names are not drawn from the jury box, a challenge may be taken to the panel on account of any bias of the officer who summoned them, which would be good ground of challenge to a juror.
2. Same — Justice Demands That Officer Summoning Talesmen Be Unbiased. It is essential to the fair and impartial administration of justice that talesmen, or a special venire, should be summoned by an officer who is not disqualified by reason of interest, bias, or prejudice.
3. Same — Discretion of Court as to Ordering Officer to Summon Talesmen. The trial court in the exercise of sound discretion has the right to issue an order commanding the sheriff, or other suitable person, to summon jurors from the body of the county, or from such portion of the county as the court may order.
4. Same — Appeal and Error — Abuse of Discretion Corrected on Appeal. If in the exercise of this right the court abuses this discretion, the appellate court will correct the same on appeal.
5. Same — Held Reversible Error to Permit Summoning of Talesmen by Sheriff Who Was Witness for State. Held, under the facts in the case at bar, the court erred in permitting the sheriff whose name was indorsed as a witness and testified for the state to summon talesmen to serve upon the regular panel, over the objection and exception of defendant.
