(Syllabus.)
1. Fines — Costs — Further Imprisonment of Convict for Service of Fine and Costs Authorized by Former Decisions. Prior to the 3rd day of October, 1935, it was the law of this state that one convicted of crime and sentenced to the penitentiary for a definite period could also be held for service of a fine and costs therein assessed. Ex parte McCoy, 45 Okla. Cr. 52, 281 P. 813. 2. Same — Further Imprisonment by Warden of Penitentiary not Authorized Since Former Decisions Overruled. Since that date, under the decision of Ex parte Red Autry, 58 Okla. Cr. 88, 50 P.2d 239, the imprisonment of a defendant by the warden of the state penitentiary to enforce the payment of a fine and costs is without authority of law.
3. Prisons — Discretion of Warden of Penitentiary as to Allowing Convict Deduction for Good Time Though Guilty of Misconduct. Section 5341, Okla. Stats. 1931 (Okla. St. Ann. tit. 57, see. 138), which provides: "Provided, however, that no convict shall be entitled to deduction for good time as herein provided in the event he has been guilty of misconduct or violation of the prison rules and regulations, unless relieved therefrom by the warden." It was intended by this provision to vest in the warden of the penitentiary the discretionary power as to what deduction of good time if any should be made for misconduct or a violation of the prison rules and regulations. This to be noted on the prison records at the time.
