(Syllabus.)
1. Witnesses — Cross-Examination of Defendant.
2. Same — Cross-Examination as to Previous Statement by Defendant — Right to Have Whole Statement Introduced. He may be cross-examined as to any statement, admission, or confession made by him at a previous time, but when so cross-examined, it is his right to have introduced before the jury the whole of said statement, admission, or confession, which is relevant to the issue involved. Record examined and found that whole statement, by admission of counsel for defendant, was admitted in evidence.
3. Appeal and Error — Sufficiency of Evidence to Sustain Verdict of Conviction. It is the rule of this court that the verdict of the jury will not be set aside for want of evidence to sustain it where there is evidence in the record from which they could legitimately draw the conclusion of the defendant's guilt.
4. Homicide — Automobiles — Manslaughter Prosecution of Intoxicated Driver — Instructions and Argument Held Free From Error. Instructions of the court examined, and found to properly state the law as applicable to the facts, and the closing argument of the county attorney to have fairly presented the issues.
5. Same — Sentence of 20 Years' Imprisonment Reduced to Ten. From an examination of the record, it is held that the judgment and sentence in this case should be reduced from 20 years in the penitentiary to a period of ten years.
