1. Intoxicating Liquors — Payment of Liquor Dealers' Tax Required by U.S. as Prima Facie Evidence of Intent to Violate Law — Statute. Section 2614, Okla. Stats. 1931, 37 Okla. St. Ann. § 81, provides: "The payment of the special tax required of liquor dealers by the United States by any person within this state, except local agents appointed as hereinbefore provided, shall constitute prima facie evidence of an intention to violate the provisions of this chapter."
2. Same — Necessary That State Prove Possession of Liquor as Alleged. Where one is charged with the unlawful possession of intoxicating liquor, and proof is made that he has purchased the special tax required of liquor dealers covering the time within which he is charged, and which constitutes prima facie evidence of an intention to violate the liquor laws, it is also necessary for the state to prove the possession of the intoxicating liquor as alleged in the indictment or information.
3. Evidence — Presumption of Innocence. Under the law every one charged with crime is presumed to be innocent until his guilt is established by competent evidence beyond a reasonable doubt.
4. Same — Evidence Held not to Overcome Presumption of Innocence. Evidence examined, and found not to overcome this legal presumption.
