(Syllabus.)
1. Intoxicating Liquors — Sale of Liquor to Officer as Unlawful as Sale to Individual. The sale of intoxicating liquor to an officer is as unlawful as is the sale of intoxicating liquor to any individual.
2. Witnesses — Witness not Incompetent to Testify Because Previously He Had Been Inmate of Insane Asylum. The fact that the individual to whom intoxicating liquor was sold had at a previous time been an inmate of a state insane asylum does not make him incompetent as a witness. The statute contemplates that he should be of unsound mind at the time the witness is called to testify.
3. Continuance — Motion Addressed to Discretion of Trial Court. A motion for a continuance is addressed to the sound judicial discretion of the trial court, and unless this discretion is abused there is no ground for error.
4. New Trial — Motion on Ground of Newly Discovered Evidence Insufficient Where It Only Tends to Discredit or Impeach State's Witness. A motion for new trial upon the ground of "newly discovered evidence" is not sufficient where it only tends to discredit or impeach the witness for the state, and especially where it would not change the result of the trial.
