(Syllabus.)
1. Trial — Asking of Improper Question by County Attorney not Necessarily Reversible Error. The asking of an improper question by the county attorney is not always reversible error, and especially where the trial court promptly sustains an objection thereto, and advises the jury not to consider the same. 2. Trial — Immaterial Testimony Properly Stricken and Jury Advised not to Consider Same. It is not error for the court to strike the evidence of a witness, and advise the jury not to consider the same, where such evidence is immaterial and has no bearing upon the issues involved.
3. Homicide — Prosecution for Attempt to Kill — Conviction for Included Offense of Assault With Dangerous Weapon — Instructions Approved. Defendant was charged with attempt to kill, and was found guilty of assault with a dangerous weapon, which is an included offense. Instructions examined and found to correctly state the law as applied to the facts.
