St. Ann. § 91 et seq., known as the Barber Board Law, is not in contravention of the terms of the Constitution of the United States and the State of Oklahoma. Ex parte Herrin, 67 Okla. Cr. 104, 93 P.2d 21; Herrin et al. v. Arnold, District Judge, 183 Okla. 392, 82 P.2d 977, 119 A. L. R. 1471; Vandervort et al. v. Keen, District Judge, 184 Okla. 121, 85 P.2d 405.
2. Statutes — Order of State Barber Board Fixing Minimum Price for Barber Work in Certain City Held not "Special or Local" Law Requiring Notice by Local Publication Prior to Passage. The order of the State Barber Board made on the 6th day of October, 1938, fixing a minimum price for barber work in the city of Stillwater is not in contravention of article 5, section 32, of the Constitution of this state, Okla. St. Ann., prohibiting the passage of special or local laws until notice shall have first been published in the city or county affected by such law. This order is not a law as contemplated by said provision, but merely a subordinate rule promulgated by them, under a policy laid down and a standard prescribed by the Legislature.
3. Trade-Marks and Trade-Names and Unfair Competition — Wide Discretion Given Board of Barber Examiners as to Scope of Investigation Before Fixing Minimum Prices for Work. By section 12, article 2, chapter 24, Session Laws, 1937, 59 Okla. St. Ann. § 102, the Legislature has given the Board of Barber Examiners wide discretion as to the extent and nature of its investigation, before entering an order establishing minimum prices for barber work within the towns or cities prescribed by the act.
4. Same — Board Without Power to Invoke Unreasonable or Arbitrary Regulations. The board does not have the power to invoke unreasonable, capricious, or arbitrary regulations against either the barbers or the public, that have no relation to the public health and welfare, under the guise of regulation of unjustifiable or unreasonable prices. If this should be attempted by the board, any aggrieved party would have the right to such redress as the law affords.
5. Same — Board not Required to Give 20 Days' Notice of Meeting Before Investigation and Fixing Minimum Prices for Work. It is not necessary for the board to give 20 days' notice of its meeting, as required by 59 Okla. St. Ann. § 67, before making an investigation and order establishing minimum prices for barber work within the towns or cities prescribed by the act. This provision only relates to the four regular quarterly meetings of the Barber Board.
6. Same — Board Need not Serve Certified Copy of Rule on Barber Before Information May Be Filed Against Him for Violation of Order. It is not necessary for the Barber Board to serve a written certified copy of the rule upon a defendant before an information may be filed against him for a violation of the order of the board. It is only necessary, as stated by section 5 of the act, 59 Okla. St. Ann. § 95, that: "Every rule or order of the board shall be posted for public inspection in the main office of the board and a certified copy filed in the office of the secretary of the board and Secretary of State of Oklahoma."
