In re Estate of Elizabeth Plummer, Deceased. Walter Plummer, Appellant, v. Charles Plummer, Appellee.

WILLS, § 24 — illness affecting capacity, evidence. Will was improperly admitted to probate, where testatrix was suffering from cancer of the uterus and a diseased liver, was in an acute diabetic condition, her attending physician testified she was in a semi-comatose condition and not competent to execute a will, both attesting witnesses testified her mind was clouded and hazy and doubted her physical and mental capacity to make a will, and will was apparently procured by proponent, who was named executor and principal beneficiary.
