James A. Maguire, v. Lux Cleaners, Inc. Lux Cleaners, Inc., Appellee,

DAMAGES, § 532 — rugs damaged by cleaner, evidence. In action by owner for rugs damaged when they were cleaned by defendant, wherein defendant impleaded the person who actually cleaned the rugs, motion for change of venue filed more than 30 days after return of summons was properly denied as not made in apt time, and judgment against impleaded defendant could not be sustained because evidence showed that the rugs had been purchased at auction or second hand a number of years before they were sent to the cleaner, the evidence as to value of the rugs being wholly insufficient.
