Appeal and Error — Prejudicial Error to Instruct on Effect of Possession of More Than One Quart of Liquor Where Less Than Quart Shown. Where one is charged with the unlawful possession of intoxicating liquor and the evidence offered by the state reveals the possession of less than one quart, it is prejudicial error for the court to instruct the jury under Oklahoma Session Laws 1933, chapter 153, section 3, O.S.A. title 37, sec. 82, which provides that the finding in excess of one quart in one's possession shall be prima facie evidence of an intention "to convey, sell or otherwise dispose of such liquors."
